Music News and New Music For October 7th, 2013

So of course, when running your own blog solo it can be tough to keep up with the s**tload of stuff that comes across our ears over a weekend!  Some good, some bad, some not even worth mentioning.  I guess that's how I use AFGM in general.  These articles that I go through everyday from various sites (Blabbermouth,. CBC, National Post, AV Club, Exclaim, Music News, Rolling Stone, etc.) and sort of "filter" some of the nonsense news such as the latest fashion design, who's got beef with who and who ISN'T doing music...still.

These articles brought forth are for a few different reasons:

1. It is relevant music information that pertains to you as a reader, no matter the level of intent or the genre.

2. They are relevant to the music I would be currently listening to or a genre I have put some attention and focus on.

3. I am somewhat patriotic about my Canadian music, so that always comes as a first for me.  I enjoy music from all parts of the world respectively, but I still have to promote local if I can.  Canadian music rocks!

4. Because it's humourous and we can ALWAYS use a good laugh.  Rarely will it be at someone's expense...but then again I am just the guy talking about it.  They're the ones causing the comments.

In Texas, Toronto music leaders urge city hall to say ‘yes’:

“Part of it is outreach work: making sure music gets out to the community, especially to neighbourhoods where they might not have any live music venues — bringing music out into the parks; they work closely with the Convention and Visitors Bureau to export musicians, making sure Austin music is being heard around the world.

But they also deal with some of the practical things that aren’t that fun — keeping an eye on permits, making sure those are awarded fairly, mediating disputes as they arise ... in the past, without that ally at a governmental level, music might have been at a disadvantage.” Jennifer Houlihan (executive director of the advocacy group Austin Music People)

Concert Review: Nine Inch Nails:

"I’m not sure that anyone went into Nine Inch Nails’ Toronto comeback gig at the Air Canada Centre Friday night expecting something substandard because substandard is not something one has come to expect from the Nine Inch Nails brand. But I’m also pretty sure the show exceeded pretty much everyone’s expectations."

Initial Ruling Made In A Day To Remember’s Lawsuit Against Victory Records:

"While Victory is disappointed with the ruling, and disagrees with the court’s conclusions, it comes as no surprise. Courts rarely grant negative injunctions of this nature, but the circumstances of this case presented a unique opportunity for such a ruling.

Having said that, in denying Victory‘s motion, the court’s reasoning actually contained silver linings that significantly favored Victory. First, the court held that it supports Victory‘s argument about the construction of the recording contract – that ADTR is still obligated to deliver two more albums to Victory – “at last equally, if not more so, than that offered by ADTR.” That is the core issue in this case and the only one that really matters in the end, so Victory is heartened that the court agreed with Victory‘s position on that core issue.

Also, the sole basis for the court’s denial of the injunction was that Victory would not suffer “irreparable harm” that could not be compensated by money damages if the album were to be self released, in that it has ample evidence to prove its damages against the band (in the form of lost profits if ADTR does proceed to self release Common Courtesy).

That is, even if the band self releases it, Victory is likely to be awarded any profits the band makes on that album, plus additional lost profits suffered by Victory based on the fact that Victory would undeniably do a far better job at marketing the album had Victory released it, which is what Victory is known for and is the reason why ADTR signed with Victory in the first place. In sum, it is a “successful” defeat in a way, and one which Victory welcomed because of the manner in which the Court rendered its opinion.

This case will proceed to trial, and Victory is looking forward to the opportunity to vindicate the baseless claims filed by ADTR.

In Defense of Post-Grunge Music:

"This feeling is at least part nostalgia; After all, I seem to have no trouble getting behind hate for the folk rock and brostep poles that are churning out the Nickelbacks of today. I’m not above reflexive disdain for music beloved by people who hear something different than I do. But, post-grunge was my hinge into alternative as it existed before the term got swallowed up by the mainstream. I’m not mad that it got me there. I was on the inside of that hatefest.
